I am a lawyer and listened to some podcasts on it. I also talk to an Indigenous law expert all the time. These cases will be back. The real question was just could the District Court do what they did in this particular case. SCOTUS ruled it could but did not rule on the big questions to reach that result. They didn't have to in other words, at least for now. But Native Americans are politically classified. Wow, if only African Americans could get that. We could then protect our shit easier. If race is not the classification, strict scrutiny is off the table. It is plain old "rational basis" test. Very low standard of review. I know the lawyers for those parents are mad as hell.
